The rules behind it
  • Program: Disability Benefits (DBL), run by NY Workers' Compensation Board.
  • Waiting period: the first 7 days are unpaid; the 26 paid weeks start after them.
  • Who qualifies: Four or more consecutive weeks with a covered employer.
  • The $170 weekly cap is written into the statute and has not changed since 1989. Many employers carry richer private short-term disability coverage on top; check your own plan.

Job protection is separate. Federal FMLA gives up to 12 weeks of unpaid, job-protected leave if your employer has 50+ employees within 75 miles and you have worked there 12 months and 1,250 hours. State paid leave usually runs at the same time, not after it.

Assumes steady pay over the past year. Benefits are figured from your quarterly wage records, so uneven pay changes the answer. Informational only, not financial or legal advice.

Asking your employer

New York pays the benefit, but your employer still needs notice. Draft a leave request letter that cites N.Y. Workers' Comp. Law §§ 204–205 and federal FMLA.
